Welcome to FalconMENA, a payments and Buy Now, Pay Later (BNPL) financial technology platform developed by GENIE AI. By engaging with this platform, you acknowledge and accept the stipulations outlined herein. These Terms & Conditions delineate the contractual obligations and rights associated with FalconMENA usage. We encourage you to review these provisions comprehensively. Use of the FalconMENA platform constitutes your acceptance of these Terms and Conditions; if you do not agree to these terms, you may not use the platform.

 

Eligibility
 

  • Utilization of FalconMENA is restricted to individuals aged 18 years and above. Proof of age may be required.

  • Users must possess valid identification and a verifiable payment method. This may include providing government-issued identification and linking a bank account or credit/debit card.

  • FalconMENA reserves the unilateral right to refuse service at its discretion, subject to regulatory compliance. This may include refusing service due to a user's credit history, location, or other factors. FalconMENA will comply with all applicable anti-discrimination laws.
     

BNPL Service Utilization
 

  • FalconMENA facilitates installment-based purchasing through its network of affiliated merchants. This allows users to split the cost of a purchase into smaller, more manageable payments.

  • Users must adhere to the structured repayment schedule stipulated during the transaction. This schedule will outline the due dates and amounts for each payment.

  • Delinquent payments may result in punitive charges, including but not limited to, interest accrual and administrative fees. FalconMENA may report late payments to credit bureaus, which could negatively impact your credit score.


Fees, Interest, and Associated Charges
 

  • Any applicable fees, interest rates, or penalties will be explicitly disclosed prior to transaction confirmation. These charges may vary depending on the merchant and the amount of the purchase.

  • FalconMENA retains the authority to revise its fee structure, contingent on prior notification to users. Notice of changes to fees will be provided through the FalconMENA platform or via email.


User Responsibilities
 

  • Users are obligated to maintain accurate and up-to-date account credentials. This includes your contact information, payment method, and other relevant details.

  • Engagement with FalconMENA must conform to lawful and ethical usage parameters. You may not use FalconMENA for any illegal or fraudulent purposes.

  • Any fraudulent or deceptive conduct will result in immediate service suspension and potential legal recourse. FalconMENA may report fraudulent activity to law enforcement.


Account Suspension and Termination
 

  • FalconMENA reserves the right to suspend or terminate accounts that contravene these Terms & Conditions. This includes accounts that are inactive, delinquent, or used for prohibited purposes.

  • Users must fulfill all outstanding financial obligations prior to account closure. If your account is terminated, you will still be responsible for any outstanding balances.


Limitations of Liability
 

  • FalconMENA disclaims liability for merchant disputes, product quality concerns, or service fulfillment issues. These disputes should be resolved directly with the merchant.

  • The platform is indemnified against unauthorized access-related losses arising from user negligence. You are responsible for maintaining the security of your account and password. FalconMENA is not responsible for any losses incurred due to your failure to do so.


Jurisdiction and Governing Law
 

  • These Terms & Conditions shall be governed by the legal frameworks of Ontario, Canada. Any disputes arising from these terms will be resolved in accordance with the laws of that jurisdiction.


Privacy

 

FalconMENA collects and uses personal information in accordance with its Privacy Policy. By using FalconMENA, you consent to the collection and use of your personal information as described in the Privacy Policy.

 

Changes to Terms and Conditions

 

FalconMENA may update these Terms and Conditions from time to time. You will be notified of any changes through the FalconMENA platform or via email. Your continued use of FalconMENA following any changes constitutes your acceptance of the revised terms.
